Contest Rules “1 chance out of 10 contest”

1. Contest Organizer

m0851 (hereinafter the“Organizer) is holding a no purchase necessary contest from January 19, 2018 at 10:00AM to February 3rd, 2018 at 6:00PM (hereinafter the “Contest”). Note that the Contest may be terminated at any time and, in any event, at the end of eighty games played by the participants or when the total maximum value of the prizes has been reached, as provided for under Section 4.

The winners will be awarded the corresponding prizes subject to be claimed under the conditions of Section 7 and within 24 hours as of the Contest being terminated.

2. Participants  

This Contest is open to persons aged 18 and over who have access to the website m0851.com/jeu (hereinafter the Site) on a cellphone using Safari for iOS users or using Chrome for Android users. 

This Contest is not open to employees, agents and representatives of the Organizer, of their affiliated, related or associated companies, of their divisions or subsidiaries, of their advertising or promotion agencies, of their partners, of participating merchants, of suppliers of prizes, materials or services related to this Contest or any other stakeholder directly related to the holding of this Contest as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any person living with such employees, agents or representatives.

Any participating minor is deemed to be participating under the control and with the consent of his or her parents or persons having parental authority, or failing that his or her legal guardians. As such, proof of authorization will be required when the prize is awarded.

You must fully agree to these Contest Rules to participate in this Contest.

The Organizer reserves the right to ask any participant to prove the conditions set out above. 

Anyone who does not satisfy these conditions or refuses to provide proof of meeting said conditions, as applicable, shall be excluded from the Contest and shall not, should he or she be a winner, be awarded the prizes.

3. How to enter the Contest

Participants can enter the Contest by going on the m0851.com/jeu website and clicking the “Start” icon. When the participant can access the electronic entry form as described herein, the participant will need to complete the form by indicating his or her last name, first name, mailing address and answer to the mathematical skill-testing question. Once the entry form is submitted, the participant will collect a single-use Contest code (via a 3D animation from which the participant will select a card from among the Contest cards) (hereinafter the “Code”). 

Participants may also choose to receive the Code by SMS, at the mobile phone number that they will provide for that purpose. By selecting this option, the participant agrees to receive the Code by SMS.

To participate without any purchase and to be entitled to win a $250 gift card, a participant may fill-up a participation form and mail it to m0851, 5555 rue Casgrain, suite 201. A participation code will be mailed back to the participant who will then be able to redeem it in store to find out if it is a winning code or not.

Participants may only enter the Contest once per business day and within the limits stipulated in Section 4.

A participant who has won a prize may enter the Contest again for up to the amount stated in Section 4.

The amount stated in Section 4 is the maximum prize that can be awarded to the participant. Consequently, no additional prize may be awarded to the participant even if the Code is a winning code. 

Entry forms may be checked by the Contest Organizer. Any entry form that is incomplete, fraudulent, sent in late, or does not have the correct answer to the mathematical skill-testing question, as the case may be, will be automatically rejected and may not qualify for a prize.

Any entry made in violation of the provisions of these Contest Rules will render the entry null and void. 

4. Prize 

The following prize will be awarded: a gift card of the equivalent amount of the items presented to the Organizer’s store cashier and scanned by that cashier (hereinafter the “Items”). Note that the maximum combined value of the prize per winner, at any one time or several times, for the same Participant is $1000 Canadian dollars excluding taxes or a $250 gift card for the participants who have followed the participation procedure without any purchase.

The maximum combined value of all prizes for all winners is eighty-five thousand Canadian dollars excluding taxes. 

Also, notwithstanding what is stipulated in Section 10, the Organizer reserves the right to terminate the Contest as soon as the maximum amount of winnings is reached.

5. Declaration of winners 

The participant will be notified whether the Code is a winning or non-winning code by a message on the card that the participant would have chosen from the Site, immediately after the store cashier has validated the Code using the method described in Section 6 below, and BEFORE any financial transaction is completed. 

6. How winners are declared

In order to declare the winners, an algorithm was implemented to ensure that from among all the games played by all participants, ten percents of said games will be winning games.

Therefore, ninety percents of all games played by all participants will be losing games.

Note that the participant’s selection of a card from the Contest cards from the Site has no bearing on the probability of the participant winning or losing. The participant’s selection has no bearing on the algorithm used. 

In the same way, the use of the Code and the algorithm by the cashier has no bearing on the results. 

7. Remittance of prizes

Prizes will be remitted in the form of a gift card for an amount equal to the Items, up to $1000 Canadian dollars excluding taxes. 

The prize shall be remitted to the winner at the Organizer’s customer service counter.

To obtain the prize, the winner will need to show the customer service manager this notice on the Site confirming the Contest Code assigned to him or her is a winning code.

The Code will be checked by the customer service manager and, if the Code is indeed confirmed to be a winning code, the winner will be remitted his or her prize within the conditions described herein. 

Moreover, the prize cannot be applied to any debt or exchanged for any good or item.

Any cost that the winner could incur to collect his or her prize will not be reimbursed or compensated by the Organizer including possible fees detailed in Section 11. 

8. Superior force or unforeseeable event

In the event of any cause not reasonably within the Organizer’s control (i.e., an inventory shortage), the Organizer may be required to modify the announced prize, whether it be the product category or the prize amount.

Consequently, the Organizer may replace the announced prize with another prize. The winner may not hold the Organizer liable.

9. Use of participants’ personal data

Information communicated by the participants are saved and used by the Organizer or its service provider for the purposes of the Contest and allows the prize to be sent.

Participants may in any event oppose to having their personal data communicated in the course of the Contest undergo any processing. Participants are also entitled to oppose to having such data used for commercial prospecting, apart from entry into this Contest. To do so, the participants concerned must send the Organizer, at the address indicated in Section 1, a letter stating their refusal to authorize the use of their data. 

Pursuant with thePersonal Information Protection and Electronic Documents Act, any participant is entitled to demand to have information relating to them that is inaccurate, incomplete, questionable or outdated to be corrected, completed, clarified, updated or deleted by sending a letter to the Organizer at the address indicated in Section 1.

Pursuant with the Act respecting the protection of personal information in the private sector, any participant is entitled to demand to have information relating to them that is inaccurate, incomplete, questionable or outdated to be corrected, completed, clarified, updated or deleted by sending a letter to the Organizer at the address indicated in Section 1.  

10. Contest Rules

The Contest Rules can also be mailed at no charge, upon request to the Organizer.  

The Organizer reserves the right to stop the Contest before the end of the period provided under Section 1 of these rules or suspend the Contest for the same period.

The Contest Organizer reserves the right to, at its sole discretion, cancel, terminate, modify or suspend this Contest, in whole or in part, should any event, error or human intervention occur that could corrupt or influence the administration, security, impartiality or conduct of the Contest as outlined in these Contest Rules, and subject to approval of the Régie des alcools, des courses et des jeux du Québec, if required. 

11. Costs incurred by participants

Costs that could be incurred from using the Site or for entering the Contest may not be reimbursed by the Organizer, including costs that could be incurred from data usage resulting in additional fees billed by the participant’s telecom operator, or any other cost that the participant may incur.

12. Intellectual property

Copying or unauthorized use of any or part of the elements comprising the Organizer’s distinguishing marks (such as brands, logos, visuals, texts, drawings, photographs or videos) is strictly prohibited

All distinguishing marks copied on the Site for the purpose of the Contest are the exclusive property of their owners and protected by intellectual property law. Unauthorized copying of such distinguishing marks is prohibited and may result in legal action by the owner.                                                                                      

13. Organizer’s liability

The Organizer may not be held liable in the event of an incident that is typical of superior force and depriving, even partially, the participants of the opportunity to enter the Contest, or the winners from collecting their prize.

The Organizer will not be held liable in the event of fraudulent use of the Site or for any malicious hacking of the data stored on the Site.

The declaration of a winner may not be challenged by another participant as the Contest is a contest of chance for the participant.

14. Disputes

The Organizer reserves the right to settle any difference that may arise with regards to the interpretation or application of these Contest Rules.

The resulting data and information from the Organizer’s computer systems or that of its service provider will be proof in the event of any dispute related to connections or the processing of data, or algorithm implemented to generate the Contest.

The computerized records kept in the Organizer’s computer systems or that of its service provider are deemed proof of the relations and communications made between the Organizer and the participant.

Any claim must be addressed to the Organizer (address in Section 1) within 30 days following the end date of the Contest indicated in Section 1. No claim will be processed at the end of such period. 

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
